Abstract
El presente trabajo aborda la maternidad por sustitución o vientre de alquiler, se busca establecer si es pertinente o no que se regule en nuestra legislación. Iniciando su análisis en un primer apartado, por medio de definiciones acerca de la infertilidad, técnicas de reproducción asistida y los diversos tipos de subrogación de vientre que podemos encontrar en la literatura. En segundo término, se realizará un profundo análisis del derecho comparado y la experiencia en nuestro propio país. Para ello, se conocerá la opinión de Consejeros Técnicos de Tribunales de Familia y se tendrá presente principios del derecho tan importantes como, el interés superior del niño o niña involucrado, el derecho a procrear, el reconocimiento de la voluntad procreacional, así como los principios de igualdad y no discriminación. Concluyendo si existe o no la necesidad jurídica su regulación legal.

Abstract
The following work tackles maternity by surrogacy, we seek to stablish if its pertinent or not that it is regulated in our legislation. Beginning its analysis in a first section, through definitions about infertility, reproduction assisted reproduction techniques and diverse types of surrogacy that we can find in literature. Second section, a deep analysis of the comparative law and the experience in our country will be made. For this, we will know the opinion of Technical Advisors of Family Courts and will have in mind principles of the law so important such as: the superior interest of the child involved, the right to procreate, the recognition of the procreative will, just as the principles of no discrimination and equality. Concluding with if it exists or not the juridical necessity of its legal regulation.
